Land Register activities

In the land registration field, within the SIS Consultancy and Services Center the office of the chartered surveyor SIMONA PASCAR operates; it provides topographical measurements and drafting files for Land Register listing, plots division, exchanges, sale and purchase of lands, setting or altering the borders, obtaining the construction permit, pegging out in constructions, roads, leveling, houses and apartments blueprint, and alterations of any type in the Land Register. At the same time, the Surveyor of the SIS Consultancy and Services Center develops also Judicial Expertise services in land survey, being licensed for that by the Ministry of Justice.

With the experience acquired in over ten years of activity, we develop cadastre, land survey and geodesic works, provided the next services:

Cadastre

The cadastre and Land Register listing services for apartments and lands located inside and outside the city limits.

  • Drafting the documentation for the first registration in the Land Register;
  • Drafting the documentation for subdivision / joining;
  • Drafting the technical documentation for registering the new building in the Land Register (building registration);
  • Technical documentations concerning cadastre Updates / Rectifications, altering the property limit or modifying the area of the real estate;
  • Splitting buildings on apartments, cellars, garages and undivided common parts;
  • Documentations for temporarily or finally removing the lands from agriculture circuit;
  • Technical documentations concerning the OCPI Technical Endorsement necessary for obtaining the City Planning Certificate or the house number;
  • Judicial and extra-judicial technical appraisals.
Land survey

Land survey, land measurements, land appraisal, and data processing services.

  • Layout for any type of platform (including the contour);
  • Surface mapping in view of drafting the blueprints of various investments (buildings, arrangements);
  • GPS measurements;
  • Pegging out the land;
  • Pegging out the building contours, the axes and quotas of the blueprint;
  • Sketches of buildings.
Necessary documents for cadastre and land register listing of an apartment

1. Title deed of the apartment:

  1. if it was purchased by the institutions of the Romanian State:
    - sale-purchase agreement or building agreement – notarized copy;
    - delivery – receipt minutes concerning the apartment – notarized copy;
    - agreement for paying in installments and certificate of having paid them in full (only for apartments purchased and paid in installments) – notarized copies;
    - notary public declaration of transcription (only for documents not transcribed in the transcriptions and inscriptions register) –original document;
  2. in the case of acquiring the apartment by inheritance:
    - inheritor certificate, including all title deeds called upon in the inheritor certificate – notarized copies;
    - notary public declaration of transcription (only for documents not transcribed in the transcriptions and inscriptions register) –original document;
  3. in the case of purchasing the apartment form a natural / legal person:
    - sale-purchase agreement or exchange agreement or donation document – notarized copy;
  4. in the case of acquiring it by a Local Court, according to a civil decision:
    - civil decision with the comment “final and irrevocable” – copy conform with the original (duplicate) issued by the Local Court;
    - proof of paying the balancing payment (if applicable) – notarized copy.
  5. in the case of apartments acquired according to Law no. 112/ 1995:
    - sale-purchase agreement – notarized copy;
    - sketch that is an annex to the agreement – Xerox copy.

2. Tax certificate for Cadastre and Land Register Listing issued by the Financial Administration – Charges and Taxes Directorate (valid on the month when the cadastre file is submitted – original document;

3. Identification documents of the owner / owners – Xerox copies;

4. Sketch of the apartment (if applicable) – Xerox copy.

* For the Inheritor Certificates and Civil Decisions issued after April 16, 2009, in addition to the amount RON 120 (normal charge), the Cadastre Office charges an additional fee of 0.15% of the value of the apartment (normal regime) or 0.75% (emergency).
** In the case when there is difference between the name registered on the title deed and the identification document, the next notarized copies will be provided in addition: Marriage Certificate (notarized copy) or Divorce Civil Decision (from the territory local court that issued the decision).
*** In the case when there is a difference between the street name in the documents and the real one, a Certificate from the Owners Association indicating the street name change will be obtained.
**** If in the former registers of real estate transcription and inscriptions a mortgage in the favor of CEC, a demand for payment, etc., that mortgage, demand, etc. will be registered in the Land Register as lien.
***** In the case when the original documents have been lost or plasticized and duplicates have been obtained, a Notary Public Declaration will be acquired from a Notary Public Office indicating that “the original title deeds have been lost in unknown circumstances and duplicates have been obtained.”

Necessary documents for cadastre and land register listing of a land (no building)
  1. Tax certificate for Cadastre and Land Register Listing issued by the City Hall – Charges and Taxes Directorate (valid on the month when the cadastre file is submitted – original document;
  2. Title deeds of the land: title deed, sale – purchase agreement, inheritor certificate, including the documents called upon in the inheritor certificate – notarized copies;
  3. Identification documents of the owner / owners – Xerox copies;
  4. Plotting plan excerpt endorsed by the City Hall (only in the case of lands outside city limits or those located “inside the new city limits”) – original document.
* For the Inheritor Certificates and Civil Decisions issued after April 16, 2009, in addition to the amount RON 120 (normal charge), the Cadastre Office charges an additional fee of 0.15% of the value of the land (normal regime) or 0.75% (emergency).

Necessary documents for cadastre and land register listing of a land (with building)
  1. Tax certificate for Cadastre and Land Register Listing issued by the City Hall – Charges and Taxes Directorate (valid on the month when the cadastre file is submitted – original document;
  2. Title deeds of the land: title deed, sale – purchase agreement, inheritor certificate, including the documents called upon in the inheritor certificate – notarized copies;
  3. Building permit and receiving minutes upon completing the works (if applicable) – notarized copies;
  4. Demolishing license and receiving minutes upon completing the demolishing works (only in the case when the title deeds indicate a building that has been demolished subsequently) – notarized copies;
  5. Identification documents of the owner / owners – Xerox copies;
* For the Inheritor Certificates and Civil Decisions issued after April 16, 2009, in addition to the amount RON 120 (normal charge), the Cadastre Office charges an additional fee of 0.15% of the value of the real estate (normal regime) or 0.75% (emergency).
Necessary documents for land register listing of a building (land register listing of a new building)
  1. Tax certificate for Cadastre and Land Register Listing issued by the City Hall – Charges and Taxes Directorate (valid on the month when the cadastre file is submitted) indicating the taxation value of the building – original document;
  2. Land Register excerpt for information purposes (recently, year in progress) – original document;
  3. Existing cadastre documentation - Xerox copy;
  4. Building permit and receiving minutes upon completing the works – notarized copies;
  5. Demolishing license and receiving minutes upon completing the demolishing works (only in the case when the old cadastre documentation and the Land Register excerpt indicate a building that has been demolished subsequently) – notarized copies;
  6. Sketches of the building (interior sketches) drafted by an architect, which were the basis of the Building Permit – Xerox copies;
  7. Title deeds proving the ownership of the land – Xerox copies;
  8. Identification documents of the owner / owners (identification documents / registration certificate for legal persons) – Xerox copies;
  9. Bank’s consent on Land Register listing (only if the land is mortgaged) – original document;
  10. Certificate concerning the street number (if applicable) – notarized copy;
  11. Proof of removing the land from the agriculture circuit (if applicable) – notarized copy.
* For the street number Certificate and / or Decision of removing the land from the agriculture circuit, the Cadastre Officer charges an additional fee of RON 60 (normal regime) or RON 300 for writing down the street address and / or changing the use category of the land in the Land Register.
Necessary documents for dividing or joining the real estates
  1. Land Register excerpt for information purposes (recently, year in progress) – original document;
  2. Existing cadastre documentation – Xerox copy;
  3. Title deeds – Xerox copies;
  4. Identification documents of the owner / owners (identification documents / registration certificate for legal persons) – Xerox copies;
  5. Bank’s consent on division / joining (only if the land is mortgaged) – original document;
  6. City Planning Certificate in the case of joining (amalgamation) – no matter the number of real estate concerned, and in the case of divisions, only for divisions of more than 3 plots (including) – original document.
Necessary documents for updating / rectifying cadastre, altering the borderline and / or modifying the land area
  1. Land Register excerpt for information purposes (recently, year in progress) – original document;
  2. Existing cadastre documentation – Xerox copy;
  3. Title deeds – Xerox copies;
  4. Identification documents of the owner / owners (identification documents / registration certificate for legal persons) – Xerox copies;
  5. Bank’s consent on the updating / rectification (only if the land is mortgaged) – original document;
  6. Certificate concerning the street number (if applicable) – notarized copy;
  7. Proof of removing the land from the agriculture circuit (if applicable) – notarized copy;
  8. Notary Public statement indicating that the owner / owners agree with altering the borderlines and the land’s area – original document.
